1. Agreement to Terms
These Terms & Conditions ("Terms") constitute a legally binding agreement between you and EJ, the owner of Goobity ("we", "us", or "our"), concerning your access to and use of the Goobity desktop software application and the goobity.fun website.
By downloading, installing, opening, or using the Goobity application, you agree that you have read, understood, and agree to be bound by all of these Terms. If you do not agree with all of these Terms, you are prohibited from using the software, and you must uninstall it immediately.
2. License Grant
We grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and run the Goobity desktop application on devices owned or controlled by you, strictly for personal, non-commercial use, subject to these Terms.
You agree not to: (a) decompile, reverse engineer, disassemble, or attempt to derive the source code of the software; (b) modify, adapt, or create derivative works based upon the software; (c) rent, lease, lend, sell, or distribute the software; or (d) remove or alter any copyright or proprietary notices within the app.
3. Payments & Premium Accounts
While a free trial or version of Goobity may be available, access to Premium eye styles, themes, and configuration limits requires a one-time purchase or active subscription fee processed via PayPal.
- Account Credentials: Premium logins are managed using secure, encrypted credentials through our authentication host (Supabase). You are solely responsible for keeping your login credentials confidential.
- Refunds: All purchases are final, subject to the Creator Program Refund rules detailed below or applicable local consumer protection laws.
4. Creator Program & Refund Rules
We run a Creator Program to reward users who share content about Goobity. Under this program, buyers of Goobity Premium may qualify for a partial or full refund rebate by publishing short-form video content (Reels, TikToks) subject to the following rules:
✦ 20,000 views on a tagged video/Reel qualifies for a 100% refund.
To qualify for the refund, the following criteria must be met in full:
- You must tag @goobity and use the hashtag #goobity in your post on Instagram or TikTok.
- Proof must be sent via email to itsmeej1307@gmail.com, including the link to the video, a screenshot showing the view count, and the email address used to purchase Goobity Premium.
- All submissions are verified manually. We reserve the absolute right to refuse any refund claim if we suspect fraud, fake/botted views, deletion or archival of the post immediately after refund processing, or other manipulative behaviors.
5. Disclaimer of Warranties
THE GOOBITY APPLICATION AND WEBSITE ARE PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE MAKE NO WARRANTIES OR REPRESENTATIONS THAT THE SOFTWARE WILL BE FREE OF BUGS, ERRORS, COMPATIBILITY CONFLICTS, SYSTEM LOCKUPS, OR INTERRUPTION. GOOBITY IS A NOVELTY SYSTEM SECURITY UTILITY INTERFACE AND SHOULD NOT BE RELIED UPON AS A HIGH-SECURITY, POLICE-MONITORED, OR CRITICAL LOSS-PREVENTION SYSTEM.
6. Strict Limitation of Liability
By using the software, you acknowledge and agree that:
- The owner is not responsible or liable for any hardware damage or operating system instability that may arise due to low-level keyboard/mouse hooks or system overlay operations.
- The owner is not liable for any unauthorized access to your computer, theft of files, or physical hardware intrusion, regardless of whether Goobity's armed alarm siren was activated, failed to trigger, or was bypassed.
- You install and grant system permissions (microphone, webcam, accessibility hooks) to Goobity entirely at your own risk.
7. Changes and Termination
We reserve the right, in our sole discretion, to modify or replace these Terms at any time. We will indicate the update date at the top of this page. Your continued use of Goobity following updates constitutes acceptance of the new Terms.
We may terminate or suspend your license and access to Premium features immediately, without prior notice or liability, if you breach any provision of these Terms.
